§ 5 Right of use
The user is granted a simple, non-transferable right to use the app on devices linked to their Apple ID. Modification, decompilation, reverse engineering or resale of the app is not permitted, except where mandatorily allowed by law.
§ 6 User obligations
- The user is responsible for the accuracy of the scale calibration and the choice of suitable input data.
- The user verifies independently whether the values calculated in the app are sufficiently accurate for their use case.
- The app must not be used for safety-critical, regulatory or cadastral-binding purposes.
§ 7 Liability
The Provider is liable in accordance with statutory provisions in cases of intent and gross negligence, in case of injury to life, body and health, and under the German Product Liability Act.
For ordinary negligence, the Provider is only liable for breaches of essential contractual obligations (so-called cardinal duties), and only for the foreseeable damage typical of the contract. Any further liability is excluded to the extent permitted by law.
In particular, the Provider assumes no liability for the accuracy of the values calculated in the app, as these depend significantly on input data and the care taken during calibration.
§ 8 Availability
The Provider endeavours to keep the app and the website continuously available, but does not guarantee uninterrupted availability. Maintenance work, updates or technical issues may lead to temporary restrictions.
§ 9 Right of withdrawal / refunds
Purchases and subscriptions are processed through Apple. Refunds are granted exclusively in accordance with Apple's terms. Requests must be addressed directly to Apple: reportaproblem.apple.com.
§ 10 Dispute resolution
The EU Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country of their habitual residence.
Should individual provisions of these terms of use be invalid, this shall not affect the validity of the remaining provisions.
